IPR Infringement Cases Processed by NPA in January 2015

The NPA uncovered a total of 272 IPR infringements in January 2015. Of which, 126 are trademark related and 146 are copyright related. Copyright infringements that involved foreign cases include 7 cases involving the U.S. and 17 cases involving Japan.

Executive Yuan approves IPR Action Plan (2015-2017) to take effect on January 1, 2015

Following the expiration of IPR Action Plan (2012-2014) on December 31, 2014, the Executive Yuan approved the latest IPR Action Plan (2015-2017) to take effect on January 1, 2015. Over the years, this Action Plan has been implemented to maintain a sound environment for IPR protection, attract R&D investment by domestic and foreign technology, cultural and creative industries, and to boost economic development. The Action Plan comprises seven major works including establishing a comprehensive regime of IPR policies and regulations, strengthening counterfeiting and piracy investigation, strengthening awareness education, and facilitating international and cross-strait exchanges and cooperation. The Action Plan has been implemented through legal and enforcement cooperation among relevant Ministries and Subordinate authorities in hopes of continually carrying out IPR protection work.

The Amended Nice Classification (NCL (10-2015)) Published on January 20, 2015

In line with WIPO’s yearly revision to the Nice Classification, TIPO has recently updated its latest compilation of the revised definitions of classification, and names of goods/services of the latest NCL (10-2015), effective starting January 1, 2015. Also updated is the comparison table of Taiwan and Japan’s respective groupings for similar goods/services under the latest NCL (10-2015), available on TIPO website starting January 21.

TIPO Concluded Examination of Over 70,000 Invention Patent Applications in 2014

Since 2010, TIPO has put a lot of effort into implementing the Executive Yuan-ratified “Patent backlog reduction project.” Over the past few years, the number of concluded examination of invention patent applications has seen a gradual increase. In 2013, that number exceeded the 60,000 mark for the first time. In 2014, TIPO was able to hit the 70,000 mark with 70,206 applications, far surpassing the project’s goal of 63,400 applications. In 2014, the number of concluded examination was 70,206, far exceeding the number of applications (41,168) requesting substantive examination in the same year. As a result, the number of invention applications pending for first office action dropped significantly. By the end of 2014, the number of pending invention applications was down to 100,041, about 28,861 applications less than those (128,902) pending by the end of 2013. The project has been well implemented, with monthly decreases continuing throughout the entire year. In addition, the yearly average of disposal pendency in 2014 was down from the 35-month goal to 33.43 months. The monthly average of disposal pendency in December 2014 was even shortened to 29.68 months, significantly cut short by eight months from the 38.12 months in December 2013. For the year 2015, TIPO expects the number of concluded examination will maintain at over 60,000, with average disposal pendency going down to less than 26 months by the year’s end.

Every year, TIPO invites IPR experts and scholars to form the “IPR protection service group” that travels across Taiwan and features lectures and activities relating to IPR. The Latest Collection of Patent Administration Litigation Cases (2013-2014) Now Available Online

TIPO’s newly compiled “Collection of patent administration litigation cases (2013-2014)” contains analyses of IP Court’s administrative ruling of 11 patent cases and the MOEA’s decisions on 16 patent appeals between August 2013 and June 2014. Starting this year, this collection is no longer available in print. E-versions of past collections (2010~) are available for downloading under the Patents section on the TIPO website.
